In Virginia, Assisted Living Facilities are licensed by 2 levels of service. Residential Living Care has minimal assistance, while Assisted Living Care has moderate assistance. 

These facilities are in a congregate residential setting. Personal care services, health care, 24-hour supervision, and general assistance for 4 or more adults that are aged, infirm, or disabled is provided or coordinated. Care, protection, oversight, and general supervision is provided for the physical and mental well being of the residents. 

Residential Living Care includes individuals with physical or mental impairments who are capable of maintaining themselves independently. They may be dependent on medication administration, but only require minimal assistance with activities of daily living. 

Assisted Living Care includes individuals with physical or mental impairments, or who are dependent on behavior patterns. They may require moderate assistance with activities of daily living. 

Other services offered in these facilities may be social and recreational activities, ambulation, arrangements for shopping and transportation, assistance with hygiene and grooming, and instrumental activities of daily living. 

Through either direct or contractual employment a dietician or nutritionist must be provided for periodic oversight of special diets. A licensed healthcare professional must also be provided, directly or contractually for periodic health care oversight and review of medications. Appropriate services for residents in need of nursing or mental health services must be provided or contracted as well. 

Facilities approved for construction or change in use and occupancy after 2/1/1996 must offer private bedrooms with at least 100 sq. ft. of usable space or shared bedrooms with at least 80 sq. ft. per resident. If not, 80 sq. ft. is required for private rooms and 60 sq. ft. per resident for shared rooms. Sleeping quarters are also required to provide at least 450 cubic feet of air space per resident. 

Facilities approved for construction or change in use and occupancy after 12/28/06 must provide at least 1 toilet and sink per 4 residents. At least 1 bath/shower is required per 7 residents. On floors with more than 4 persons, bathrooms must be separated by sex. Older facilities must offer 1 toilet and sink per 7 residents as well as 1 bath/shower per 10 residents. On floors with more than 7 persons, bathrooms must be separated by sex.
